5-401 Student Disciplinary Procedures

A

The purpose of this policy is to establish disciplinary procedures to guide the enforcement of the Student Code of Conduct. These procedures are applicable to any student or student organization that is charged with a violation of the Student Code of Conduct.

     
B   These disciplinary procedures are designed to allow for fact-finding and decision-making in the context of an educational community, and to encourage students to accept responsibility for their own actions. The intent is to provide adequate procedural safeguards to protect the rights of the individual student and the legitimate interests of the university.
     
C   The universities may use mediation or conciliation procedures in addition to these disciplinary procedures in accordance with policies and procedures adopted by each university.
     
D   Student records that, in accordance with the Family Educational Rights and Privacy Act (FERPA), are generated during the information gathering/decision-making process associated with these procedures are confidential.

The definitions provided elsewhere in this chapter are also applicable to this policy except where otherwise indicated.

     
B   The following additional definitions are included in this policy:

"Adviser" means an individual selected by the student to advise him/her. The adviser may be a faculty or staff member, student, attorney, or other representative of the student.

     
2   "Complainant" means any individual who initiates the referral procedures set forth in the policy.
     
3   "Day" means normal university business day, not including Saturday, Sunday, any officially recognized university employee holiday, or any day the university is closed.

"Vice President for Student Affairs" means the administrative officer bearing such title, related title, or his/her designee.

     
     
All policies found in the Policy Manual are subject to change from time to time as approved by the Arizona Board of Regents. The central office disseminates hard copies of additions/revisions not more than 3 times each year. The web copy, located at http://www.abor.asu.edu, is updated every 1-2 months, as needed. Prior to acting in reliance upon a specific board policy as it appears in any copy of the policy manual, please check to make sure that the board has not recently approved any additions/revisions to that specific policy.
